DECISION OF THE EEA JOINT COMMITTEE No 5/2025

amending Annex I (Veterinary and phytosanitary matters) to the EEA Agreement [2025/736]

THE EEA JOINT COMMITTEE,

Having regard to the Agreement on the European Economic Area (“the EEA Agreement”), and in particular Article 98 thereof,

Whereas:

(1) Commission Implementing Regulation (EU) 2024/2183 of 2 September 2024 amending Implementing Regulations (EU) No 389/2011, (EU) No 2016/899, (EU) 2017/440, (EU) 2017/896, (EU) 2020/164, (EU) 2020/166, (EU) 2021/2051, (EU) 2021/2096, (EU) 2023/1167, (EU) 2023/1703 and (EU) 2023/1713 as regards the name of the holder of the authorisation for feed additives ( 1 ) is to be incorporated into the EEA Agreement.

(2) Commission Implementing Regulation (EU) 2024/2185 of 3 September 2024 concerning the authorisation of a preparation of Bacillus subtilis FERM BP-07462, Enterococcus lactis FERM BP-10867 and Clostridium butyricum FERM BP-10866 as a feed additive for all poultry species for fattening, all poultry species reared for laying or breeding and ornamental birds (holder of authorisation: Toa Biopharma Co., Ltd.) ( 2 ) is to be incorporated into the EEA Agreement.

(3) This Decision concerns legislation regarding feedingstuffs. Legislation regarding feedingstuffs shall not apply to Liechtenstein as long as the application of the Agreement between the European Community and the Swiss Confederation on trade in agricultural products is extended to Liechtenstein, as specified in the sectoral adaptations to Annex I to the EEA Agreement. This Decision is therefore not to apply to Liechtenstein.

(4) Annex I to the EEA Agreement should therefore be amended accordingly,

HAS ADOPTED THIS DECISION:

Article 1

Chapter II of Annex I to the EEA Agreement shall be amended as follows:

The following indent is added in points 2zd (Commission Implementing Regulation (EU) No 389/2011), 167 (Commission Implementing Regulation (EU) 2016/899), 205 (Commission Implementing Regulation (EU) 2017/440) and 211 (Commission Implementing Regulation (EU) 2017/896):

‘—

32024 R 2183 : Commission Implementing Regulation (EU) 2024/2183 of 2 September 2024 ( OJ L, 2024/2183, 3.9.2024 ).’

The following is added in points 342 (Commission Implementing Regulation (EU) 2020/164), 344 (Commission Implementing Regulation (EU) 2020/166), 431 (Commission Implementing Regulation (EU) 2021/2096), 436 (Commission Implementing Regulation (EU) 2021/2051), 500 (Commission Implementing Regulation (EU) 2023/1167), 508 (Commission Implementing Regulation (EU) 2023/1703) and 516 (Commission Implementing Regulation (EU) 2023/1713):

‘, as amended by:

— 32024 R 2183 : Commission Implementing Regulation (EU) 2024/2183 of 2 September 2024 ( OJ L, 2024/2183, 3.9.2024 ).’

The following point is inserted after point 613 (Commission Implementing Regulation (EU) 2024/2441):

‘614.

32024 R 2185 : Commission Implementing Regulation (EU) 2024/2185 of 3 September 2024 concerning the authorisation of a preparation of Bacillus subtilis FERM BP-07462, Enterococcus lactis FERM BP-10867 and Clostridium butyricum FERM BP-10866 as a feed additive for all poultry species for fattening, all poultry species reared for laying or breeding and ornamental birds (holder of authorisation: Toa Biopharma Co., Ltd.) ( OJ L, 2024/2185, 4.9.2024 ).’

Article 2

The texts of Implementing Regulations (EU) 2024/2183 and (EU) 2024/2185 in the Icelandic and Norwegian languages, to be published in the EEA Supplement to the Official Journal of the European Union , shall be authentic.

Article 3

This Decision shall enter into force on 8 February 2025, provided that all the notifications under Article 103(1) of the EEA Agreement have been made ( *1 ) .

Article 4

This Decision shall be published in the EEA Section of, and in the EEA Supplement to, the Official Journal of the European Union .
